HJ Shipbuilding & Construction Wins Damages Lawsuit Against Shipowner Greenwich
.South Korean shipbuilder HJ Shipbuilding & Construction (HJSC) recently celebrated a legal victory in a damages lawsuit filed by the international shipowner Greenwich Shipping S.A. The Seoul Central District Court made a significant decision by dismissing the shipowner’s claim for damages, amounting to a substantial 10.2 billion KRW (approximately $7.5113 million). Additionally, the court ruled in favor of HJ Shipbuilding & Construction in a separate damages lawsuit, ordering the shipowner to pay 816.01 million won (approximately $600,900) in damages.
Root of the Legal Dispute: Engine Incident During Repairs
The legal dispute between HJ Shipbuilding & Construction and the Shipowner originated from an engine incident that occurred on the vessel named “Poseidon Hellas” during repair works. Investigations revealed that defects in the main engine repair work, carried out by the shipowner themselves, were identified as the primary cause of the unfortunate incident.
Court’s Verdict and Company’s Response
The court determined that the shipbuilding company bore no liability for the incident and hence dismissed all claims made by the shipowner. In a statement following the ruling, a representative from HJ Shipbuilding & Construction expressed relief at the conclusion of the prolonged legal battle, highlighting the elimination of management uncertainties and associated liability risks that had lingered for years.
