Saipem Resumes Operations in Brazil

A Brazilian court has granted the Italian engineering and construction giant Saipem permission to resume its operations in Brazil. This decision comes after a lengthy suspension that lasted two years. The suspension was a result of an investigation into alleged irregularities related to a contract signed with Petrobras, Brazil’s state-controlled oil company. The ruling marks a significant turning point for Saipem, allowing it to re-enter the Brazilian market and engage with public sector projects once again.

Background of the Suspension

Saipem faced serious allegations that led to its suspension from signing new contracts with the Brazilian public administration. The investigation focused on a deal made in 2011, where it was claimed that a representative of Saipem bribed a former Petrobras director. This bribery was allegedly aimed at securing a lucrative $140 million contract for pipeline installation under the BM-S-11 consortium. Such allegations raised significant concerns about corruption and ethical practices within the company.

In response to these allegations, the Controladoria-Geral da União (CGU), Brazil’s federal auditing agency, imposed a two-year ban on Saipem and its Brazilian subsidiary. This ban prevented them from entering into contracts with any public administration in Brazil. The suspension had a considerable impact on Saipem’s operations, limiting its ability to participate in major projects in one of the world’s largest markets for oil and gas. The company faced not only financial losses but also reputational damage during this period.

Recent Court Ruling and Implications

In October, the Federal District Court of Brasilia annulled the CGU’s order, allowing Saipem to challenge the suspension. However, the annulment was initially subject to an appeal phase, which is a standard procedure under Brazilian law. During this phase, the effects of the annulment were temporarily suspended, leaving Saipem in a state of uncertainty.

Last Friday, the court issued a decisive ruling that the annulment of the suspension was effective immediately, regardless of any pending appeals. This ruling means that Saipem and its Brazilian subsidiary, Saipem do Brasil, can now operate freely with state-owned companies in Brazil. Saipem expressed its relief and optimism in a statement, highlighting that it can once again engage in the Brazilian market without restrictions. This development is expected to open new opportunities for Saipem, allowing it to participate in upcoming projects and strengthen its presence in Brazil’s energy sector.
